Dust and odour from nearby activities can be unpleasant and sometimes affect how you use your home or garden. Fylde Borough Council investigates complaints where these issues may meet the legal definition of a statutory nuisance under the Environmental Protection Act 1990.

What We Can Investigate

We can investigate cases where dust or odour:

  • Is persistent or recurring
  • Significantly affects your daily life or property
  • Comes from an identifiable source such as construction sites, industrial premises, agriculture, or commercial activities

Each complaint is assessed on its own merits, based on the frequency, duration, and impact of the problem.

What We Can’t Deal With

We cannot take formal action on:

  • One-off or short-term issues
  • General smells from rural or open areas not linked to a specific activity
  • Dust generated by long periods of dry weather
  • Cooking odours from domestic properties i.e. barbeques
  • Complaints outside our remit (e.g. those regulated by the Environment Agency – we’ll let you know if this applies)
